Learning Assistant Campus ("LA Campus") Portal Terms of Use

Acceptance of the Terms of Use
These terms of use are entered into by and between user of the LA Campus Portal (“you”) and
University of Colorado ("University," "we," or "us"). The following terms and conditions and
any document referenced herein (collectively, "Terms of Use"), govern your access to and use
of, including any content, functionality, and services offered on or through the LA Campus Portal
located at learningassistantalliance.org (the "Portal").
Please read the Terms of Use carefully before you start to use the Portal. By using the Portal,
you accept and agree to be bound and abide by these Terms of Use and our Privacy Policy,
found at https://learningassistantalliance.org/doc/LAA_Privacy_and_Terms_of_Use.pdf, and
incorporated herein by reference. If you do not want to agree to these Terms of Use or the
Privacy Policy, you must not access or use the Portal.
By using this Portal, you represent and warrant that you are of legal age to form a binding
contract with the University and meet all of the foregoing eligibility requirements.
Changes to the Terms of Use
We may revise and update these Terms of Use from time to time in our sole discretion. All
changes are effective immediately when we post them, and apply to all access to and use of the
Portal thereafter.
Your continued use of the Portal following the posting of revised Terms of Use means that you
accept and agree to the changes. You are expected to check this page so you are aware of any
changes, as they are binding on you.
Accessing the Website and Account Security
We reserve the right to withdraw or amend this Portal, and any service or material we provide on
the Portal, in our sole discretion without notice. We will not be liable if for any reason all or any
part of the Portal is unavailable at any time or for any period. From time to time, we may restrict
access to some parts of the Portal, or the entire Portal, to any users.
To access the Portal or some of the resources it offers, you may be asked to provide certain
registration details or other information. It is a condition of your use of the Portal that all the
information you provide on the Portal is correct, current, and complete. You agree that all
information you provide to register with this Portal or otherwise, including, but not limited to,
through the use of any interactive features on the Portal, is governed by this Terms of Use,
including our Privacy Policy, and you consent to all actions we take with respect to your
information consistent with the Terms of Use and Privacy Policy.
If you choose, or are provided with, a user name, password, or any other piece of information as
part of our security procedures, you must treat such information as confidential, and you must
not disclose it to any other person or entity. You also acknowledge that your account is personal
to you and agree not to provide any other person with access to this Portal or portions of it using
your user name, password, or other security information. You agree to notify us immediately of
any unauthorized access to or use of your user name or password or any other breach of security.
You also agree to ensure that you exit from your account at the end of each session. You should
use particular caution when accessing your account from a public or shared computer so that
others are not able to view or record your password or other personal information.
We have the right to disable any user name, password, or other identifier at any time in our sole
discretion, including if, in our opinion, you have violated any provision of these Terms of Use.
Intellectual Property Rights
The Portal and its entire contents, features, and functionality (including but not limited to all
information, software, text, displays, images, video, and audio, and the design, selection, and
arrangement thereof) are owned by the University, its licensors, or other providers of such
material and are protected by United States and international copyright, trademark, patent, trade
secret, and/or other intellectual property or proprietary rights laws. You must not, and agree that
you will not, delete any copyright, trademark, or other proprietary rights notices from copies of
materials on the Portal.
These Terms of Use permit you to use the Portal solely for the purposes of the Learning Assistant
program, and in all use cases not for commercial purposes. You agree to not reproduce,
distribute, modify, create derivative works of, publicly display, publicly perform, republish,
download, store, or transmit any of the material on the Portal, except as needed in relation to
your Learning Assistant program.
If you print, copy, modify, download, or otherwise use or provide any other person with access to
any part of the Portal in breach of the Terms of Use, your right to use the Portal will stop
immediately and you must, at our option, return or destroy any copies of the materials you have
made.
No right, title, or interest in or to the Portal or any content on the Portal is transferred to you, and
all rights not expressly granted are reserved by the University.
Trademarks
The University name, logo, and all related names, logos, product and service names, designs, and
slogans are trademarks of the University or its licensors. You must not use such marks without
the prior written permission of the University.
Prohibited Uses
You may use the Portal only for lawful purposes and in accordance with these Terms of Use. You
agree not to use the Portal:
• In any way that violates any applicable federal, state, local, or international law or
regulation (including, without limitation, any laws regarding the export of data or
software to and from the US or other countries).
• For the purpose of exploiting, harming, or attempting to exploit or harm minors in any
way by exposing them to inappropriate content, asking for personally identifiable
information, or otherwise.
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the
Portal, or which, as determined by us, may harm the University or users of the Portal, or
expose them to liability.
Additionally, you agree not to:
• Use the Portal in any manner that could disable, overburden, damage, or impair the site or
interfere with any other party's use of the Portal, including their ability to engage in real
time activities through the Portal.
• Use any robot, spider, or other automatic device, process, or means to access the Portal
for any purpose, including monitoring or copying any of the material on the Portal.
• Use any manual process to monitor or copy any of the material on the Portal, or for any
other purpose not expressly authorized in these Terms of Use, without our prior written
consent.
• Use any device, software, or routine that interferes with the proper working of the Portal.
• Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is
malicious or technologically harmful.
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the
Portal, the server on which the Portal is stored, or any server, computer, or database
connected to the Portal.
• Attack the Portal via a denial-of-service attack or a distributed denial-of-service attack.
• Otherwise attempt to interfere with the proper working of the Portal.
Data Collection
You warrant that all data collected or submitted through the use of this Portal or the associated
services will be collected in accordance with applicable privacy regulations.
We will collect and store the following data from students involved:
• Identification information
• Contact Information
• Voluntarily submitted demographic information
• Learning assistant application responses including but not limited to self-reported
academic information
We will collect the following data from faculty:
• Identification information
• Contact Information
• Voluntarily submitted demographic information
• Course information
The University also collects or links the following data from you:
o The Carnegie Classification of Institutions of Higher Education (CCIHE) is
utilized by the LA Campus system to set up campus profiles.

o In the absence of CCIHE data, self-reported institutional information is collected
(e.g. Research Institution, HSI, etc.).
o The University aggregates lists of courses being taught on your institution from
faculty inputs.
We will not collect social security numbers or student IDs from students, instructors or faculty.
Your Data Use
• You agree not to share data, copy and paste, or download data beyond the capabilities of
the system
• No course, instructor, or student data from the Portal may be used for any purpose other
than the Learning Assistant program or transferred by non-secure methods.
• User message system may only be used for purposes intended by LA Campus, having to
do with the LA program.
• Personal Information Collection and Use. Personal information collected on this
website is meant to facilitate interactions within the LA Alliance community and
personalize the experience of users. Certain information provided at account creation and
verification (name, affiliation, department, position, email, phone) is included in the LA
Alliance directory, which is searchable and can be viewed by other verified account
members. The LA Alliance does not otherwise disclose, give, or transfer identifiable
information to third parties without user consent or unless required by law.
• Research. To facilitate the rigorous empirically driven improvement of STEM education,
data from LA Campus may be anonymized, aggregated with similar institutions, and
shared with educational researchers who have approved IRB protocols. Anonymized data
will not be shared with individuals who are not listed on researchers’ respective IRB
protocols.
Data Storage and Security:
1. Data storage and security is in concurrence with the policies of the University of
Colorado Office of Information Security (OIS). The data stored by the system is
classified as Highly Confidential Information. For more information, please see https://

www.cu.edu/ope/aps/6005.
2. All data that have been collected and generated using LA Campus software applications
are stored in a database hosted in a private IP address space on a firewalled server at the
University of Colorado Boulder (CU Boulder).
3. Server management is provided by the CU Boulder Office of Information Technology’s
server management group. Direct access to the database is restricted to LAA database
managers using specific IP addresses.
4. LA Campus software applications are hosted separately on a server also managed by
University of Colorado Boulder’s Office of Information Technology (OIT).
5. LA Campus has undergone and passed intensive penetration testing by the OIT.
6. LA Campus software utilizes the Higher Education Community Vender Assessment
Toolkit Light (HECVAT Light) to describe the adherence to security standards which can
be found here: HECVAT Lite.
7. Data is encrypted both in transit and at rest.
Monitoring and Enforcement
We have the right to:
• Take any action that we deem necessary or appropriate in our sole discretion, including if
we believe any user content infringes any intellectual property right or other right of any
person or entity, threatens the personal safety of users of the Portal or the public, or could
create liability for the University.
• Disclose your identity or other information about you to any third party who claims that
material posted by you violates their rights, including their intellectual property rights or
their right to privacy.
• Take appropriate legal action, including without limitation, referral to law enforcement,
for any illegal or unauthorized use of the Portal.
• Terminate or suspend your access to all or part of the Portal for any or no reason,
including without limitation any violation of these Terms of Use.
Without limiting the foregoing, we have the right to cooperate fully with any law enforcement
authorities or court order requesting or directing us to disclose the identity or other information
of anyone posting any materials on or through the Portal. YOU WAIVE AND RELEASE ANY
AND ALL CLAIMS RESULTING FROM ANY ACTION TAKEN BY UNIVERSITY
DURING, OR TAKEN AS A CONSEQUENCE OF, INVESTIGATIONS BY EITHER THE
UNIVERSITY OR LAW ENFORCEMENT AUTHORITIES.
Accordingly, we assume no liability for any action or inaction regarding transmissions,
communications, or content provided by any user or third party. We have no liability or
responsibility to anyone for performance or nonperformance of the activities described in this
section.
Content Standards
These content standards apply to any and all user contributions and use of interactive services.
User contributions must in their entirety comply with all applicable federal, state, local, and
international laws and regulations. Without limiting the foregoing, user contributions must not:
• Contain any material that is defamatory, obscene, indecent, abusive, offensive, harassing,
violent, hateful, inflammatory, or otherwise objectionable.
• Promote sexually explicit or pornographic material, violence, or discrimination based on
race, sex, religion, nationality, disability, sexual orientation, or age.
• Infringe any patent, trademark, trade secret, copyright, or other intellectual property or
other rights of any other person.
• Violate the legal rights (including the rights of publicity and privacy) of others or contain
any material that could give rise to any civil or criminal liability under applicable laws or
regulations or that otherwise may be in conflict with these Terms of Use and our Privacy
Policy.
• Be likely to deceive any person.
• Promote any illegal activity, or advocate, promote, or assist any unlawful act.
• Cause annoyance, inconvenience, or needless anxiety or be likely to upset, embarrass,
alarm, or annoy any other person.
• Impersonate any person, or misrepresent your identity or affiliation with any person or
organization.
• Involve commercial activities or sales, such as contests, sweepstakes, and other sales
promotions, barter, or advertising.
• Give the impression that they emanate from or are endorsed by us or any other person or
entity, if this is not the case.
Copyright Infringement
If you believe that any user contributions violate your copyright, please contact
contact@learningassistantalliance.org. It is the policy of the University to terminate the user
accounts of repeat infringers.
Reliance on Information Posted
WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF
USER CONTRIBUTIONS. ANY RELIANCE YOU PLACE ON SUCH INFORMATION IS
STRICTLY AT YOUR OWN RISK. WE DISCLAIM ALL LIABILITY AND
RESPONSIBILITY ARISING FROM ANY RELIANCE PLACED ON SUCH MATERIALS
BY YOU OR ANY OTHER VISITOR TO THE PORTAL, OR BY ANYONE WHO MAY BE
INFORMED OF ANY OF ITS CONTENTS.
WE ARE NOT RESPONSIBLE, OR LIABLE TO YOU OR ANY THIRD PARTY, FOR THE
CONTENT OR ACCURACY OF ANY MATERIALS PROVIDED BY ANY USERS OF THE
PORTAL OR THIRD PARTIES.

Geographic Restrictions
The owner of the Portal is based in the State of Colorado in the United States. We provide this
Portal for use only by persons located in the United States. We make no claims that the Portal or
any of its content is accessible or appropriate outside of the United States. Access to the Portal
may not be legal by certain persons or in certain countries. If you access the Portal from outside
the United States, you do so on your own initiative and are responsible for compliance with local
laws.
Disclaimer of Warranties
You understand that we cannot and do not guarantee or warrant that files available for
downloading from the internet or the Portal will be free of viruses or other destructive code. You
are responsible for implementing sufficient procedures and checkpoints to satisfy your particular
requirements for anti-virus protection and accuracy of data input and output, and for maintaining
a means external to our site for any reconstruction of any lost data. TO THE FULLEST

Accessibility
The University strives to provide all users with access to the full functionality of LA Campus
software through supporting assistive technology to a reasonable degree based on the Web
Content Accessibility Guidelines (WCAG) 2.1 criteria.
The University uses commercially available tools to evaluate the accessibility of LA Campus
software and incorporates the resulting findings into continuous updates.
Waiver and Severability
No waiver by the University of any term or condition set out in these Terms of Use shall be
deemed a further or continuing waiver of such term or condition or a waiver of any other term or
condition, and any failure of the University to assert a right or provision under these Terms of
Use shall not constitute a waiver of such right or provision.
If any provision of these Terms of Use is held by a court or other tribunal of competent
jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be
eliminated or limited to the minimum extent such that the remaining provisions of the Terms of
Use will continue in full force and effect.
Termination
Your access to the Portal will be terminated when your affiliated entity’s contract terminates with
University. (i.e., your access will terminate when your own college/university’s contract for the
Portal use terminates with us). Your data will remain on the database on University of Colorado
Boulder servers and will only be used by University as specified in these Terms of Use and our
Privacy Policy.
Entire Agreement
This Terms of Use and our Privacy Policy constitute the sole and entire agreement between you
and University regarding the Portal and supersede all prior and contemporaneous understandings,
agreements, representations, and warranties, both written and oral, regarding the Portal.
Your Comments and Concerns
This Portal and the associated website is operated by the University of Colorado Boulder, 249

other communications relating to the Portal should be directed to:
